Intellectual Property & DMCA Policy
Effective date:
We respect the intellectual-property rights of artists, brands and creators, and we expect our customers to do the same. This policy explains our rules and how to report infringement.
1. Customer artwork
Customers may upload and print only artwork they own or have permission to use. Under our Terms of Service, customers confirm they hold all necessary rights, and we may refuse or cancel any order we believe infringes copyright, trademark, or publicity rights.
At checkout every buyer confirms that they own or have permission to use all uploaded artwork. Our Terms of Service give us only a limited license to reproduce, print and process that artwork to fulfil the order, and we do not use it in marketing without the customer's opt-in consent. We do not pre-screen uploads, but we may refuse, cancel or stop any order that we believe infringes intellectual-property, publicity or privacy rights, or is illegal or offensive.
2. Our intellectual property
The stickerlovable name, logo, website design, online designer, product photos and text belong to [Legal business name] or its licensors and may not be used without our written permission.
3. Reporting copyright infringement (DMCA notice)
If you believe that an order, product or content on our site infringes your copyright, send a written notice under the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512) to our designated agent. Your notice must include:
- your physical or electronic signature;
- identification of the copyrighted work you believe is infringed;
- identification of the infringing material and enough information for us to locate it (for example a URL, a product name or an order reference);
- your name, postal address, telephone number and email address;
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law;
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.
Designated agent: [DMCA agent name], Copyright Agent for [Legal business name], [DMCA agent postal address]. Phone: [DMCA agent phone]. Email: stickerlovable@gmail.com (subject line: "DMCA notice").
What happens after a valid notice: we act promptly to remove or disable access to the material — for example by removing content from our site, or by cancelling orders that have not yet been printed or shipped (with a refund under our Terms of Service) — and we notify the affected customer, usually with a copy of the notice (we may redact the sender's personal contact details where the law allows). We may not act on incomplete notices and may ask you to complete them. Rights holders outside the United States may use the same process.
4. Counter-notice
If you believe material was removed or an order was cancelled because of a mistake or misidentification, you may send a counter-notice to our designated agent including:
- your physical or electronic signature;
- identification of the material removed and where it appeared before removal;
- a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification;
- your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district in which we may be found) and will accept service of process from the person who submitted the original notice.
Where the law allows, we may restore the material 10 to 14 business days after receiving a valid counter-notice unless the complaining party tells us it has filed a court action.
5. Repeat infringers
We maintain a repeat-infringer policy. We keep a record of valid notices against the customer account or checkout email address concerned. In appropriate circumstances — for example after two or more valid notices within any 12-month period that were not successfully countered — we will close the customer's account, refuse further orders from that account or email address, and remove their content. We may act sooner in clear or serious cases.
6. False claims
Under 17 U.S.C. § 512(f), anyone who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for damages. Please make sure your claim is valid before submitting it.
7. Trademark and other complaints
To report trademark infringement or unauthorized use of a person's name or likeness, email stickerlovable@gmail.com with your contact details, the right being infringed, and the order or content concerned. We will review it and take appropriate action.
